AFFF and PFAS settlements

Settlements over PFAS and firefighting foam have paid out billions, but water utilities and states receive nearly all of that money. Not one firefighter injury case has settled so far. Below: who paid, how much, who gets the money, and what lawyers think injury cases could be worth.

The list goes from the largest amount to the smallest. Each company's agreed payment appears in the amount column; the last column shows who receives it.

Firefighters who have cancer aren't included on this list. Their injury claims remain open in MDL 2873, and no payments have gone out on them.

3M PFAS settlement

Under the deal, public water suppliers whose water showed PFAS can receive up to $10.3 billion from 3M across 13 years. The top of the range, $12.5 billion, shows up in some reports. Court approval came in 2024.

The funds cover testing and treatment for drinking water. It leaves a firefighter's own injury claim untouched, and firefighters cannot sign up for it.

DuPont and Chemours PFAS settlements

Three large deals are shared by DuPont, Chemours (its spin-off) and Corteva. Water systems received $1.185 billion from them in 2024.

On August 7, 2026, approval came for New Jersey's settlements with 3M and DuPont-related companies, deals worth about $2.5 billion across 25 years. North Carolina's claims were settled for $455 million over 15 years by the three companies on September 10, 2026.

Chemours PFAS lawsuits

In the turnout gear suits and the firefighter injury cases, Chemours is a defendant as well. So far its settled cases involve states or utilities, not personal claims.

AFFF settlement amounts and payout estimates

Nobody has agreed on any tier for injuries. One plaintiffs' firm posts these guesses for firefighter cases, arranged by how strong they are:

TierWhat kind of caseEstimated range
Tier 1Years of exposure on the job plus kidney or testicular cancer$200,000 to $600,000
Tier 2Cases with less exposure or a weaker medical link$150,000 to $200,000
Tier 3The weakest cases that still qualifyUnder $75,000

View these numbers as estimates that come from just one firm. No court or company has agreed to them, and any final deal could end up different.

Is there a PFAS class action?

The water deals were class settlements, so a whole group of utilities shared one agreement. Injury cases for firefighters run differently.

Every injury case stands as its own lawsuit. One court holds the cases together, so shared steps go before a single judge, and each claim then gets valued on its own.

The PFAS MDL in plain words

Multidistrict litigation is what MDL stands for. Federal foam cases nationwide have gone to a single judge, Richard M. Gergel in South Carolina, since December 2018. The pending count was about 15,264 in October 2026.

What a firefighting foam settlement means for you

A sick firefighter gets none of the money above. Two routes can: a case in the MDL for your injury, which has to be filed and follow the rules of the court, and a claim for workers' comp under the cancer law of your state, which does not wait for any settlement.

Check your state's law or read the AFFF lawsuit update.

Settlement questions

Is the AFFF lawsuit a class action?

No. Each firefighter case is a separate lawsuit, and all of them are grouped in MDL 2873. Class settlements applied only to the water-system deals.

When will the AFFF lawsuit settle?

A date hasn't been set. Mediation talks are still going, and the court hasn't yet picked the next test cases. Proposals are due November 20, 2026.

What is the average payout for the AFFF lawsuit?

No injury case has settled, so an average doesn't exist yet. For the strongest cases, lawyers for the plaintiffs guess between $200,000 and $600,000. Treat those numbers as estimates, not offers, and check settlement amounts.

Can a firefighter claim money from the 3M settlement?

No. Public water systems get the money under the 3M deal. An injury claim from a firefighter requires its own case to be filed.
